Texas Tax Sales

There are no tax liens in Texas. For failure to pay taxes, a lien to foreclose can be put on the property.

If orders to foreclosure the property are approved to satisfy the lien, an auction for cash occurs. The county sheriff (sheriff auction sales), or precinct constables auction the property on the county courthouse steps. These auctions occur on the first Tuesday of the month.

The highest bidder receives a sheriff’s deed. The ownership is held off for 180 days or a 2 year right of redemption is held by the former property owner at the time of the sale.

Tax Lien Tip

Unlike personal debts, tax liens on real estate "run with the land"; that is, a property owner becomes responsible for payment even if the tax obligation was incurred by a prior owner. Depending on the law of the state or jurisdiction, the owner of the property may also be personally liable for payment of the taxes.
